wedding agreement
ENTIRE AGREEMENT
This agreement contains the entire understanding between the photovideographer and the client. It supersedes all prior and simultaneous agreements between the parties. In the event that the parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both parties.
PRICING
The client agrees to pay the photovideographer, a sum of in consideration of the services to be rendered by Just Stay Natural. The total cost is due even if the client stops the event before the end time established in this agreement. The client agrees to pay each additional hour that the photovideographer stays more than the agreed coverage time.
RETAINER AND PAYMENT
The photovideographer shall reserve the time and date of services by signing and returning this contract along with a non-refundable, non-transferable retainer fee of 30% of the total cost. No date is reserved until the contract and retainer are received. The balance due for the photography and/or videography services must be paid in full no less than 3 days after the wedding. The photovideographer is not responsible for reminding the client for the due of payments. In the event that the client fails to remit payment as specified, the photovideographer shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid.
CANCELLATION
At the time the contract takes effect, the photovideographer shall reserve the date and time agreed upon, and not make any reservations or accept any other clients for the said date and time. For this reason, in the event that the client cancels the contract for any reason other than a mandatory lockdown due to a pandemic (including COVID19) , the photovideographer will keep the retainer and any payments made up to the point of cancellation in order to offset its loss of business. If cancelling this contract, the client must notify the photovideographer in writing as well as sign a cancellation contract provided by Just Stay Natural.
RESCHEDULING
If the client needs to reschedule the event date, all money paid will transfer to the new date per a newly written and signed contract if the date is available for the photovideographer. The new date must be within six months of the original day. If the new date is unavailable for the photovideographer, the contract will be cancelled and the retainer shall not be refunded.
SAFETY
The photovideographer reserves the right to terminate coverage and leave the location of the event if the photovideographer experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the event; or in the event that the safety of the photovideographer is in question. The photovideographer shall be entitled to retain all monies paid hereunder and the client agrees to relieve and hold the photovideographer harmless as a result of incomplete wedding photography and/or videography coverage. It is understood that the photovideographer will not negotiate any services with anyone not stated in this contract.
STYLE
No shots throughout the day are guaranteed (such as but not limited to, formals, first kiss, bouquet toss, etc). The client acknowledges that the photovideographer is using their artistic discretion to create photographs and videos as the photovideographer sees fit. The photovideographer retains the right to refuse to take images contrary to their photographic/videographic style and inappropriate images including but not limited to in undergarments and sexually suggestive poses (joking or not). Every effort will be made to assure satisfaction according to the photographers professional standards. However, the photovideographer is not responsible for subjective interpretations of photography/videography.
RESPONSIBILITIES
It is understood that Just Stay Natural shall be the exclusive photographer or videographer retained for the event. The photovideographer may bring an assistant at their discretion. Other vendors must not obstruct or interfere with the official photography/videography. Wedding guests may take photos, but it is the responsibility of the client to prevent family and friends from interfering with the photovideographer's duties. Guests will be asked to refrain from taking flash photographs at certain intervals of wedding services to ensure proper exposure of images. The photovideographer is not responsible for compromised coverage due to causes beyond their control such as other people's camera or flash, the lateness of the bride, groom, family members and bridal party members or other principles, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiate. The photovideographer is not responsible for wardrobe malfunctions or the client's physical appearance. The photovideographer reserves the right to refuse to take equipment out in the rain/snow and in or near water. The photovideographer is not responsible for any damage or injuries that may be sustained due to but not limited to photos/videos taken in or near water.
COVERAGE
The photovideographer will provide coverage for the dates, locations and continuous hours specified in this agreement. Coverage begins as soon as the photovideographer arrives at the location. Every reasonable effort will be made to take requested pictures and videos, but no specific pose or photograph can be promised. Any lists supplied or requested photos will be used for organizational purposes only. While the photovideographer will make every reasonable effort to take photos and/or videos specifically requested by the client, the client understands that this is an uncontrolled event and that due to the vagaries of the weather, available light, time restrictions, willingness of subject, etc. the photovideographer cannot possibly guarantee that all requested photos and/or videos will be taken. The photovideographer will use their professional judgment and sole discretion to select which photos and/or videos to deliver. Such selection shall constitute all images that will be made available to the client.
MEAL AND BREAK
It is the client's option to provide the photovideographer a meal with assigned seating and dairy-free option for events of six hours or longer. If no meal is provided, it is understood the photovideographer will leave the event for a half hour to purchase a meal. Meal breaks do not pause the consecutive wedding photography and/or videography coverage. The photovideographer is not responsible for any photos and/or videos that may be missed while obtaining a meal.
CAPTURE AND DELIVERY
The determination of images and/or videos delivered to the client, including music, video editing, etc. is left to the discretion of the photovideographer. The client will receive their final high resolution, edited JPEG images and/or high quality 4K videos via a password protected private online gallery and/or video sharing link no later than 120 days following the event.. The final post production and editing styles, effects, and overall look of the images and/or videos are left to the discretion of the photovideographer. Unedited videos are delivered to the client as one continuous video, but no raw photos shall be provided to the client. The images will be delivered in high resolution edited JPEG format only. No re-editing will be done after the final edited photos are presented to the client. The client shall request minor changes to the tones of the images and the editing of the video, no later than one month after the wedding. The entire video can be re-edited at a rate of €20/hour
ARCHIVING PHOTOGRAPHS & VIDEOS
Photovideographer will archive digital files of all photos and/or videos taken for the client for a maximum period of 1 month. After this period, only the final, delivered images and/or videos are archived for long-term.The photovideographer does not guarantee back-up photographs and/or videos, prints or data after this time.
LIMITED LIABILITY
In the unlikely event that the photovideographer is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the photovideographer, the photovideographer will return all retainers and fees to the client but shall have no further liability with respect to this contract. The photovideographer have working methods in place to prevent loss or damage to your images and/or videos. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the photovideographer's control, including but not limited to camera, hard drive, or equipment malfunction, the photovideographer liability is limited to the return of all payments received for the shoot.
COPYRIGHT
The copyright of photographs and/or videos remains with the photovideographer. The images and/or videos taken by the photovideographer are for personal use by the clients, their friends and relatives. Sale, publication or any commercial use of the photographs and/or videos is not allowed without prior written permission from the photovideographer.
MODEL RELEASE
The client hereby assigns the photovideographer the irrevocable and unrestricted right to use and publish photographs and/or videos of the client or in which the client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The client releases all claim to profits that may arise from use of images and/or videos. The photovideographer shall provide the possibility for the client to indicate which images and/or videos does not wish to be published and used as described above (in particular, celebrities, public figures and politicians appearing at the wedding).
